Terms & Conditions.

These Terms & Conditions (“Terms”) govern your access to and use of the IndieCrew website, platform, and related services (“IndieCrew”, “the Platform”, “we”, “us”, “our”).

By accessing or using IndieCrew, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

Governing Law: Republic of South Africa.

IndieCrew is a digital platform designed to support independent freelance crew in the film, media, and creative industries. IndieCrew is not a crewing agency and does not act as a representative, intermediary, or negotiator for any crew member or production.

The Platform provides visibility, profile hosting, discovery tools, and community driven resources for independent professionals.

To use IndieCrew, you must:

• Be at least 18 years old • Be legally capable of entering into binding agreements • Be an independent contractor in South Africa • Provide accurate and truthful information during registration

We may request verification of your identity or professional status at any time.

To access certain features, you must create an account. You agree to:

• Provide accurate, complete, and up to date information • Maintain the confidentiality of your login credentials • Accept responsibility for all activity under your account • Notify us immediately of any unauthorised access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or compromise platform integrity.

If you create a crew profile, you acknowledge that:

• You are responsible for updating your profile after each engagement • All information you provide must be truthful and accurate • You negotiate your own rates, contracts, and terms of employment • IndieCrew does not participate in or influence your earnings • You grant IndieCrew permission to display your profile and professional information to productions and platform users

IndieCrew may remove or edit content that is misleading, harmful, or violates these Terms.

IndieCrew operates on a subscription model for crew members. By subscribing, you agree that:

• Subscription fees are payable in advance • Your subscription renews automatically unless cancelled • Fees may change, and you will be notified in advance of any adjustments • Your subscription must remain active for your profile to remain visible

Refunds: Subscription fees are non refundable unless required by law. Pro rated refunds may apply only where mandated under the CPA.

Your subscription may be:

• Month to month, renewing automatically • Fixed term, where applicable

In accordance with the CPA:

• Fixed term agreements may not exceed 24 months unless expressly agreed and beneficial to the consumer • Fixed term agreements automatically convert to month to month upon expiry unless cancelled

7.1 Cancellation by the Subscriber

You may cancel your subscription:

• At any time • For any reason • By providing 20 business days’ written notice

Upon cancellation, you will remain liable only for:

• Fees for services already rendered up to the cancellation date • Any reasonable costs directly related to the cancellation, as permitted by the CPA

No cancellation penalties, early termination fees, or administrative charges will apply.

7.2 Cancellation by IndieCrew

IndieCrew may cancel your subscription by providing 20 business days’ written notice if:

• You materially breach these Terms • You fail to make payment • You engage in prohibited or harmful conduct • The Platform undergoes structural or operational changes

For fixed term subscriptions, IndieCrew will notify you 40–80 business days before expiry. The notice will include:

• Renewal options • Any changes in fees • Your right to cancel

If you do not respond, the subscription automatically converts to month to month.

You agree not to:

• Misrepresent your identity, skills, or professional history • Upload harmful, offensive, or unlawful content • Interfere with platform functionality or security • Use IndieCrew for fraudulent or exploitative purposes

We may suspend or remove accounts that violate these standards.

All content on the IndieCrew website—including branding, design, text, graphics, and software—is owned by IndieCrew or licensed to us.

You may not:

• Copy, reproduce, distribute, or modify any part of the Platform • Use IndieCrew branding without written permission

Your uploaded content remains yours, but you grant IndieCrew a non exclusive license to display, store, and use it for platform functionality.

IndieCrew processes personal information in accordance with the Protection of Personal Information Act (POPIA).

We commit to:

• Collecting only necessary information • Storing data securely • Not selling or sharing personal information without consent • Allowing you to request access, correction, or deletion of your data

A full Privacy Policy is available on the Platform.

The Platform may contain links to third party websites or services. IndieCrew is not responsible for:

• The content or accuracy of third party sites • Any transactions or interactions you have with third parties

Use these links at your own discretion.

IndieCrew is provided “as is” and “as available”.

We do not guarantee:

• Continuous or error free operation • Availability of specific crew or production opportunities • Accuracy of user generated content

You use the Platform at your own risk.

To the fullest extent permitted by law, IndieCrew is not liable for:

• Loss of income, contracts, or business opportunities • Damages arising from user interactions or employment negotiations • Any indirect, incidental, or consequential damages

Your engagement with productions is entirely independent of IndieCrew.

You agree to indemnify and hold IndieCrew harmless from any claims, damages, or liabilities arising from:

• Your use of the Platform • Your professional conduct • Your breach of these Terms

IndieCrew may update these Terms periodically. Continued use of the Platform after changes indicates your acceptance of the revised Terms.
